Meeting of Holmer and Shelwick Parish Council at 7:00PM on Monday 9th December 2019 at Holmer Park Spa, Cleeve Orchard, Hereford, HR1 1LL

1. Apologies for absence
Apologies were approved from Andy Coultas, Gitta Ferguson and Neil Duggan.

2. Declarations of Interest
Nil declared.

3. Dispensations
Nil received.

4. Open Session
The meeting was adjourned for the open session.

4.1. Ward Councillor
Mark Millmore provided a report. It was confirmed that the planning application for 191770 (Land East of Canon Pyon) had been approved by the Herefordshire Council Planning Committee by one vote. A full copy of the latest report, including an update on planning application 191770, is available on Councillor Millmore’s website.

4.2. Footpath Officer
Duncan Smart provided a report as follows:
• A request had been received from a parishioner to investigate footpath HO1 to Pipe and Lyde, as the path had become very muddy and difficult to navigate. The Footpaths Officer had reviewed the location but unfortunately there was very little that could be done to improve the surface at this time.
• An enquiry had been lodged with Balfour Beatty Living Places regarding the closure of the footpath PL9, it was noted that the closure had been extended by Welsh Water.
• Footpath HO10 has been surveyed and clearance work had been undertaken.

4.3. Public participation
No questions were received.

The meeting resumed following the open session.

5. To consider and adopt the minutes from the Parish Council meeting on Monday 11th November 2019
It was resolved to adopt the minutes as a true record and these were signed by the Chair.

6. Progress reports

6.1. Councillor vacancy
It was noted that there was still one vacancy on the Parish Council and applications from parishioners were welcomed.

6.2. S106 traffic calming scheme
Herefordshire Council had confirmed that the Traffic Regulation Order consultation for the proposed traffic calming scheme should commence January 2020.

6.3. Cycleway/footway, Roman Road
Herefordshire Council and Bloor Homes had requested a meeting with the Parish Council to review this issue, it was resolved to arrange a meeting early 2020.

6.4. Pond maintenance
It was suggested that the easiest method to maintain the pond would be to utilise a grab lorry; it was agreed to pursue quotes for this for consideration at a future meeting.

6.5. Feedback from NDP workshop event
An update was provided as follows:
• Herefordshire Council are currently reviewing their Core Strategy.
• All Neighbourhood Development Plans, once approved, start with full weight in planning terms but this is eroded over the years until it is next reviewed and revised.

6.6. P191770 (land east of Canon Pyon Road)
An update was provided by the Ward Councillor under item 4.1.

6.7. Tour of parish with Locality Steward
It was noted that a tour of the parish with the Locality Steward would be organised for January 2020 (date not yet confirmed).

6.8. Smart Water
It was noted that the Smart Water kits had been ordered.

7. Correspondence

7.1. Herefordshire Council: Initial consultation for the implementation of no waiting at any time (double yellow line) restrictions on Green Wilding Road, Hereford.
It was resolved to write in support of the proposals.

7.2. Burghill Parish Council: Complaint to Herefordshire Council regarding P191770.
It was resolved to write a formal complaint to Herefordshire Council regarding the handling of this planning application. It was felt that greater weight should have been placed on the Holmer and Shelwick NDP as although it had not yet gone through referendum it had been passed by the examiner. It was asserted that the developer had intentionally misled the planning committee on a number of issues, including on the integrity of the Neighbourhood Development Plan.

7.3. Herefordshire Association of Local Councils: To note the latest training schedule.
The latest training schedule was noted.

8. Parish matters for discussion/decision

8.1. Defibrillators
It was resolved to defer discussion on this to a future meeting.

8.2. Tree management
It was noted that the work had been completed by Chapel Tree Services but the chippings had not been removed from site as originally requested. Councillors would survey the work done to see if it was considered satisfactory.

9. Burial Ground

9.1. Memorial Safety Survey
It was hoped that this would be undertaken January 2020.

10. Planning

10.1. Neighbourhood Development Plan
The final version of the plan was now complete following revisions recommended by the Independent Examiner and it was resolved to approve this and send to Herefordshire Council to progress to referendum.

Herefordshire Council would be contacted for advice on how to publicise the NDP and upcoming referendum.

10.2. NDP Examiners Report
The examiner’s report was noted and the necessary changes to the plan had been made already.

10.3. P193732/FH: Hawthorne Farm Shelwick Hereford Herefordshire HR1 3AS. Site a static caravan for very occasional use with new green septic tank.
It was resolved to write in objection to the proposals as it was felt that sufficient information had not been provided as to the reason or justification for the static caravan. It was requested that the applicant might also share the pre-application advice received so that consultees were better informed.

10.4. P194064/F: Larch House Lyde Cross Munstone Hereford Herefordshire HR1 3AD. Proposed change of use of agricultural land to domestic, use moving the ‘native species hedgerow’ to the northern boundary.
It was resolved that the Parish Council object to the proposals. It is felt that the plans submitted with the proposals are not acceptable as there is insufficient detail to allow proper consideration.

Notwithstanding the above, the Parish Council would like to highlight that there is a historic Public Right of Way that crosses this land, this can be seen on the attached plan. Whilst this PRoW has not been included on the definitive map, an attempt to register the path could be made anytime up until 2026 and this is being considered locally.

The Parish Council also remain concerned that the landscape scheme relating to application 171008/F had still not been implemented.

10.5. P193984/F: Field 8200 adjacent to Bramble Field Barn Shelwick Lane Munstone. Proposed relocation of an existing agricultural building and stable.
It was resolved that the Parish Council had no objections or concerns.

10.6. P194000/A: Hereford Audi, Legion Way, Hereford, Herefordshire, HR1 1LN. 1 no. double-sided single pole sign.
It was resolved that the Parish Council object to the proposals. The adjacent roads and junction have suffered from a number of vehicle collisions and are considered locally to be an accident blackspot. It is strongly asserted that the proposed new sign would be a distraction to drivers, to the detriment of highway safety at this critical location. It was noted that a similar sign had recently been removed from the nearby Volkswagen dealership.

11. Finance

11.1. Budget expenditure
It was resolved to approve the budget expenditure.

11.2. Bank reconciliation
It was resolved to approve the bank reconciliation.

11.3. Schedule of payments
It was resolved to approve the schedule of payments and cheques were duly signed.

11.4. Bank mandate
It was noted that the bank mandate paperwork had been submitted and was being processed.

12. Councillors’ reports and items for the next agenda
The dog fouling bins need emptying and the Parish Council signs need replacing.

It was resolved to add the following items to the next agenda:
• NDP referendum
• S106 review
• S106 traffic calming
• Cycleway/footway, Roman Road
• Pond maintenance
• Memorial safety survey
• Smart Water

13. Date of the next meeting
The next scheduled meeting is at 7:00PM on Monday 13th January 2020.

The meeting closed at 8:15PM.
