Minutes

Present: Marc Mohan (Chairman), David Cooper (Vice-Chairman), Neil Flanagan, Andy Coultas, Gitta Ferguson, Tanya Walshe (from 7:24PM)

1. Apologies for absence
No apologies were received.

2. Declarations of Interest
John Phipps declared a Disclosable Pecuniary Interest in item 10.1.

Neil Flanagan declared a Disclosable Pecuniary Interest in items 10.5 and 10.6.

Marc Mohan declared a Disclosable Pecuniary Interest in items 10.5 and 10.6.

3. Dispensations
Nil received.

4. Co-option
An application to fill the councillor vacancy had been received from Tanya Walsh and it was resolved to co-opt her onto the council with immediate effect. Details of available training courses would be circulated when available.

5. Open Session
The meeting was adjourned for the open session.

5.1. Ward Councillor
No report was available.

5.2. Footpath Officer
Duncan Smart provided a report on the Public Rights of Way network. Fly tipping on bridleway HO18 had been reported to Herefordshire Council. Complaints had been received regarding horses using footpath HO8A, it was resolved to publicise this on the Parish Council’s website.

5.3. Public participation
A member of the public raised concerns regarding the Holmer West development; Bloor Homes were installing play equipment in an area that was due to be planted with trees (adjacent to 3/5 Dale Drive). Concern was also raised that the bank adjacent to Ayles Brook would not be maintained once the development had been completed.

The meeting resumed following the open session.

6. To consider and adopt the minutes from the Parish Council meeting on Monday 9th November 2020
It was resolved to adopt the minutes as a true record and they were duly signed by the Chair.

7. Progress reports

7.1. Councillor vacancies
It was noted that there were now two vacancies on the Parish Council and applications from parishioners were welcomed.

7.2. S106 traffic calming scheme
Herefordshire Council had stated that they were reviewing how they commission S106 works and were not pursuing such works at this time. It was resolved to make a complaint to Herefordshire Council in order to expedite this longstanding issue.

7.3. Flooding issues, Shelwick
This had been raised with the Ward Councillor to try and expedite the matter; no update was available.

7.4. Bund / floor levels, Holmer West
No update was available.

7.5. Traffic concerns, Cleeve Orchard
The manager at Holmer Park Spa had confirmed the following actions:
• All members had been written to about the traffic concerns and it had been included in their newsletter.
• Observations and visitor logs had shown that visitor numbers were much lower than they were in January 2020.
• A “please respect our neighbours” sign would be added to the car park exit and speed limit signing / white lining was being investigated for the car park.

7.6. Littering and dog fouling
This had been raised with the Ward Councillor to try and expedite the matter; no update was available.

8. Correspondence

8.1. Herefordshire Council: Notice of disposal under the Community Right to Bid scheme (Localism Act 2011), The Rose Gardens PH t/a Secret Garden Hereford, HR1 1LH (now expired).
The above notice of disposal was noted.

8.2. Herefordshire Council: The future of rubbish and recycling in Herefordshire consultation.
It was resolved to defer discussion until the next meeting.

8.3. Herefordshire Council: Future of Mobility: Rural Strategy – call for Evidence consultation.
It was resolved to defer discussion until the next meeting.

9. Parish matters for discussion/decision

9.1. Smart Water: To consider the distribution of Smart Water kits to parishioners and to consider purchasing additional kits.
It was noted that the previously purchased Smart Water kits would only cover distribution to approximately 75% of the parish, as this was the threshold needed to be eligible for the associated road signage. As it was now proposed to distribute the kits via post (due to the Coronavirus lockdown measures) this would mean that not every parishioner would receive a kit. It was resolved to purchase the additional 275 kits required to allow 100% coverage at a cost of approximately £1830.00.

9.2. Hedge cutter: To consider quotes for the purchase of a hedge cutter for use by the Footpaths Officer.
Three quotes were considered for a replacement hedge cutter. It was resolved to purchase a battery powered Stihl unit from Ron Smith & Co. at £363.75 plus VAT. This would be added to the asset register accordingly.

9.3. Pond, Coldwells Road: To consider quotes for maintaining the Parish Council’s pond.
Quotes were considered for maintaining the Parish Council’s pond. A quote from TW Jones was approved and it was resolved to approve up to £750.00 to remove up to three loads from the pond.

9.4. Herefordshire Council ‘report a problem’: To receive an overview on reporting issues to Herefordshire Council.
Councillors and members of the public were encouraged to use Herefordshire Council’s ‘report a problem’ app or website to log highway maintenance issues and other problems.

10. Planning

10.1. P203525/F: Land adj. to Bank Lodge, Coldwells Road, Holmer, Herefordshire. Proposed cottage, garage and revised access.
John Phipps had declared an interest and so left the meeting for the duration of this item.

It was resolved that the Parish Council had the following comments:
• An ecology report should be provided and available for inspection.
• The application form is incorrect as it states that no trees/hedgerows are to be removed, however the plans show that a number of shrubs/trees would need to be removed to facilitate the proposals.
• The supplied plans are not adequate, with no dimensions explicitly shown.
• It is uncertain if pre-application advice has been sought from the planning department, as stated on the application form.

10.2. P203392/V: 8 Turnberry Drive, Holmer, Hereford, Herefordshire, HR1 1LP. Proposed extension measuring 5.25m x 2.20m.
It was resolved that the Parish Council had no objections or concerns.

10.3. P201682/RM (re-consultation): Holmer House Farm, Holmer, Hereford. Application for approval of Reserved Matters following hybrid approval (P184662/O) for the erection of 83 dwellings including open space, access, drainage and other associated works.
It was noted that the Bloor Homes had provided feedback to the various consultee responses, including commenting on the suitability of the Parish Council’s Neighbourhood Development Plan and policy HS4b (parking provision).

It was resolved to submit a further objection and to respond to the specific issues and assertions of Bloor Homes.  The Parish Council’s NDP is a statutory document and it is not for developers to determine its suitability.  There is a wealth of evidence showing that the levels of parking provision currently proposed will lead to significant parking and obstruction issues to the detriment of amenity and the quality of life of future residents.

10.4. P203809/J: Land to rear of 9 Cleeve Orchard, Hereford, HR1 1LF. Proposal to works to Yew tree to reduce height of approx. 3 mtrs and reduce spread by same.
It was resolved that the Parish Council had no objections or concerns.

10.5. P203765/FH: Westlands, Coldwells Road, Holmer, HR1 1LH. Proposed alterations to widen the existing gated driveway access and replacement of windows with new timber sash windows.
Marc Mohan and Neil Flanagan had declared an interest and so left the meeting for the duration of this item; David Cooper chaired.

It was resolved that the Parish Council were generally supportive of the application, but that the following comments would be made:
• It was felt that the changes to the gate would still not allow a car to get off the road before entering the property; consideration should be given to a sliding gate, or setting the gate back further into the property to allow this.
• There is concern regarding the structural integrity of the boundary / retaining wall and investigations should be undertaken to confirm its stability before work to the gate is undertaken.

10.6. P203766/L: Westlands, Coldwells Road, Holmer, Herefordshire, HR1 1LH. Proposed alterations to widen the existing gated driveway access and replacement of windows with new timber sash windows.
Marc Mohan and Neil Flanagan had declared an interest and so left the meeting for the duration of this item; David Cooper chaired.

It was resolved that the Parish Council were generally supportive of the application, but that the following comments would be made:

10.7. P203501/AM: Land to the north of the Roman Road and west of the A49 Holmer West Hereford. Proposed non-material amendment to permission 182712 (Application for approval of Reserved Matters (Phase 2) following outline approval (150478/O) for the erection of 221 dwellings including open space, access, drainage and other associated works) – To allow additional tree planting in the southern area of the POS adjacent to Dale Drive.
It was resolved that the Parish Council object to the application.

It was felt that this application is potentially misleading. The latest plans (WE086-LS-016k) show that additional play equipment is proposed for installation adjacent to Dale Drive, but this is not stated in the application form or covering letter.

The Parish Council are supportive of additional planting and screening but object to the siting of the additional play equipment. It is felt that the location is unsafe being only a short distance via the shared cycle/footway from the busy A49. It is also felt that the close proximity of the play equipment to existing residents of Dale Drive will create an unacceptable level of noise, especially considering the significant height differential.

11. Burial Ground

11.1. To receive an update
There were no matters to report.

11.2. Memorial repairs
Quotes were considered relating to the repair of unsafe memorials. It was resolved to approve a quote totalling £960.00 (plus VAT) from NC Pegler Monumental Sculptors to make safe five unstable memorials.

12. Finance

12.1. Budget expenditure
It was resolved to approve the budget expenditure.

12.2. Bank reconciliation
It was resolved to approve the bank reconciliation.

12.3. Schedule of payments
It was resolved to approve the schedule of payments and cheques were duly signed.

13. Councillors’ reports and items for the next agenda
It was resolved to add the following items to the next agenda:
• Post box Munstone Road / Roman Road (disappeared)
• Signage / obstruction issues, Parish Council’s pond
• Pedestrian improvements, Roman Road / Munstone Road
• Road widening, Church Way development
• Ward Councillor updates on various issues
• The future of rubbish and recycling in Herefordshire consultation

14. Date of the next meeting
The next scheduled meeting is at 7:30PM on Monday 11th January 2020.
