Meeting of the Parish Council at 7:00PM on Monday 10th September 2018 at Holmer Park Health Club & Spa, Cleeve Orchard, Hereford, HR1 1LL


Present: Mark Millmore (Chair), Marc Mohan, Angela Tyler, Andy Coultas, David Cooper

In attendance: David Hunter-Miller (Clerk), representatives of Balfour Beatty Living Places, members of the public

1. Apologies for absence
Apologies were received from Gitta Ferguson and Neil Flanagan.

2. Co-option
One application had been received and this would be considered at the next meeting of the Parish Council.

3. Declarations of Interest
Angela Tyler declared a Disclosable Pecuniary Interest in item 9.4.
Andy Coultas declared a Disclosable Pecuniary Interest in item 9.7.
Marc Mohan declared a Disclosable Pecuniary Interest in item 9.2.
Mark Millmore declared a Non-Pecuniary Interest in item 9.2.

5. Open Session
The meeting was adjourned for the open session.

  1. Balfour Beatty
    Balfour Beatty Living Places had undertaken an informal consultation on their traffic calming proposals and over 100 visitors had attended the event.
    Refined proposals would be developed based on the feedback received and these would then be subject to statutory consultation.
  2. Ward Councillor’s Report
    Andrew Round (Ward Councillor) sent apologies.
  3. Footpath Officer’s Report
    The strimmer had its annual service which had reduced the amount of path clearance work undertaken.
    A suggestion was made that councillors and residents could survey paths on an informal basis to highlight any areas that might require attention.
  4. Public participation
    A member of the public raised an issue with a blocked ditchcourse that had been reported to Balfour Beatty Living Places. Vehicles had been using a footpath as a shortcut and this had been reported to Herefordshire Council.
    A number of queries were raised regarding the proposed traffic calming scheme for Shelwick:
  • A member of the public raised concern at some of the proposals and queried if further consultation would be undertaken; representatives of Balfour Beatty Living Places confirmed that this was an initial consultation only and further formal consultation would be undertaken.
  • Members of the public felt that the proposals to cul-de-sac Attwood Lane were undesirable and would create further traffic safety issues.
  • A member of the public queried whether cyclists would be encouraged to use Church Way; representatives of Balfour Beatty Living Places confirmed that this was one of the options being considered.
  • A member of the public queried if the speed limit could be reduced further, to 20mph; representatives of Balfour Beatty Living Places confirmed that this would necessitate additional features that would be considered undesirable.
  • A member of the public raised concern at the proposed use of vertical traffic calming features.
    The meeting resumed following the open session.

6. To consider and adopt the minutes from the Parish Council meeting on Monday 9th July 2018.
It was resolved to adopt the minutes as a true record and these were signed by the Chairman.

7. Progress reports

  1. Holmer West Development and the proposed combined cycleway/footway
    An interim response had been received from Herefordshire Council and a full response was anticipated.
  2. The Rose Garden Asset of Community Value application
    Herefordshire Council had been contacted for an update.
  3. HO-8 obstruction of footpath
    The Footpaths Officer confirmed that the path was now passable. It was resolved to send a letter to residents adjacent to the footpath to ask them to refrain from dumping garden waste along the path.

8. Correspondence

  1. Herefordshire Council’s budget consultation
    It was resolved that the Parish Council had no comments or objections.
  2. Public Spaces Protection Order for Dog Control and the offer of additional signage
    It was resolved that additional signs would not be required.
  3. Herefordshire Council’s consultation on the Children and Young people’s Plan
    It was resolved that the Parish Council had no comments or objections.
  4. Hereford Area Plan, Housing and Employment Site Options Consultation
    Concerns were raised at the proposed development boundaries in the Hereford Area Plan. It was anticipated that the Parish Council’s Neighbourhood Development Plan would come into force before the Hereford Area Plan was adopted.
  5. Balfour Beatty Road resurfacing C1125 and complaints received
    An enquiry had been received regarding Balfour Beatty Living Places’ planned highway repair work from Aylestone roundabout to Shelwick junction, which had been aborted. Herefordshire Council’s Cabinet Member for Transport, Barry Durkin, had been contacted and a response was awaited.
  6. Herefordshire Council’s invitation to attend the Parish Council Summit to be held on the 17th October in Hereford
    It was resolved that David Cooper and Mark Millmore would endeavour to attend the event.
  7. Maintenance and repair of war memorials in preparation of the 100th anniversary of the First World War.
    It was resolved to contact Holmer Church to see if any assistance was required in keeping their war memorial plaque in good condition.
  8. Herefordshire Council’s review of highways maintenance and pothole repairs
    It was resolved to comment that the coordination of pothole repairs was considered inadequate as the maintenance gangs attending to repair the highway often ignore any nearby potholes.

9. Planning

  1. Neighbourhood Development Plan
    An update was received from the steering group; the plan was being refined further with regard to settlement boundaries and green open spaces. The final draft would be circulated for approval by the Parish Council, and this could then go forward to the first stages of public consultation.
  2. 182485: Copelands, Church Way, Holmer, Hereford HR1 1LL. Proposed new dwelling within private domestic garden.
    Marc Mohan had declared a Disclosable Pecuniary Interest and left the room for this discussion.
    Mark Millmore had declared a Non-Pecuniary Interest.
    Comments had been received for consideration at the meeting, suggesting that the proposed dwelling would have an adverse effect on the setting of a listed building and not enough consideration has been given to the foul drainage and water supply.
    It was noted that Herefordshire Council had proceeded to comment on the application despite assurances that the matter would be deferred until after the Parish Council meeting.
    It was resolved that the Parish Council had no objections or comments.
  3. 182712: Land to the North of the Roman Road and West of the A49, Holmer West, Hereford. Reserved matters (Phase 2) following outline approval 150478/O, for the erection of 203 dwellings including open space, landscaping, drainage and other associated works.
    A large number of plans had been submitted in relation to this application. It was resolved to lodge the following comments and observations:
    • It is noted that the Environment Agency and Open Space Officer seek further information to make an informed consultation response and ask that such information, once received, is sent to the Parish Council to comment on further.
    • Serious concerns were raised relating to the proposed hedging and trees. It was understood that an existing property adjacent to the proposed development has had remedial work undertaken for subsidence due to the close proximity of nearby trees and it is felt that the proposed hedging and tree planting would have a similar detrimental impact.
    • Clarification is sought on who will maintain the hedging and the triangular section of field to the east due to there being no direct access from the open space. The cycle/footway needs to be designed so that cyclists and pedestrians will use it as such hedging and trees will create a dark route potentially leading to anti-social problems for neighbouring residents.
    • In regards to the house designs and materials they are in general conformity with the first phase thus no further comment is given.
  4.  182641: Land adjoining Fairleigh, Shelwick Green, Hereford, HR1 3AW. Reserved matters following outline approval 162436/O (two bedroom cottage).
    Angela Tyler had declared a Disclosable Pecuniary Interest and left the room for this discussion.
    It was resolved that the Parish Council had no objections or comments.
  5. 182786: Apple Tree Cottage, Shelwick, Hereford, Herefordshire HR1 3AW. Single storey extension to side elevation.
    It was resolved that the Parish Council had no objections or comments.
  6. 183050: Land adjacent to Clover Cottage, Shelwick, Herefordshire. Proposed general purpose agricultural building.
    It was resolved that the Parish Council would object to the application as there were reservations regarding the need for an agricultural building given the small area of land that it served.
  7. 182817: Wyoming, Shelwick Lane, Shelwick, Hereford. Site for an extension to an existing garage to form new dwelling.
    Andy Coultas had declared a Disclosable Pecuniary Interest and left the room for this discussion.
    It was resolved that the Parish Council had no objections but a query would be raised on how foul waste would be disposed of and whether there was approval for the property to be serviced by the Shelwick shared waste system.
  8. 182935: Rushford, Belle Bank Avenue, Holmer, Hereford, Herefordshire HR4 9RL. Proposed Garage and Alterations.
    It was resolved that the Parish Council had no objections or comments.
  9. 182621: Brayleigh, Coldwells Road, Holmer, Hereford, Herefordshire HR1 1LH. Proposed balcony to rear elevation.
    It was resolved that the Parish Council would object to this application.
    A condition on the previous application (163390RM dated 01/12/16) stated that upper windows should be obscured and unable to be opened to ensure the privacy of the adjacent properties. The proposed balcony would result in an unacceptable reduction in amenity to neighbouring properties.
  10. 182893: Sports Ground And Club Room, Old School Lane, Hereford, Herefordshire, HR1 1EX. Construction of an external 3G Artificial Turf Pitch (ATP) with fencing, floodlighting, a storage container.

It was resolved to write in support of the application.

10. Parish matters for discussion/decision

  1. Newsletter
    The Parish Council’s proposed newsletter was discussed. Additional content would be added regarding volunteers to monitor the public rights of way network.
  2. Lengthsman
    No issues were reported.
  3. Dog Fouling Bin
    The location of the dog fouling bin on Coldwells Road was considered; it was resolved to relocate the bin to an alternative location on Coldwells Road away from the pond and residential properties.
    It was resolved to attach the dog fouling posters to the dog fouling bins, the Parish Council’s noticeboards and on the railings of the play areas.
  4. S106 funding
    A spreadsheet was circulated from Herefordshire Council detailing S106 contributions relevant to the parish.
    It was resolved to support the introduction of traffic calming and a lower speed limit, noting the comments and concerns of residents. The Clerk would submit detailed comments to Balfour Beatty Living Places following the meeting.
  5. Wentworth Park
    It was resolved that this play area would not be adopted by the Parish Council and should continue to be maintained by Herefordshire Council.
  6. Standing Orders
    It was resolved to adopt revised standing orders as per NALC recommendations LO9-18.
  7. Street Lighting
    It was resolved to request that streetlighting was installed on the built-up areas only and not in open countryside.
    Low impact lighting that minimises light pollution was requested for the proposed ‘Park and Choose’ site.

11. Finance

    It was resolved to settle the above invoices and cheques were duly signed.

    The above payments were noted.
  7. To consider and approve budget expenditure
    It was resolved to approve the budget expenditure.
